Swan makes available to its customers the Swan mobile application (hereinafter the "Application") allowing them to prove their identity, perform strong authentication, authenticate themselves to access their payment or electronic money account (hereinafter the "Account") and prepare or authorise transactions.
The terms of use of the Account are defined in the general conditions of use or the general conditions of use of electronic money.
Access to and use of the Application that is the subject hereof implies the User's prior and unreserved acceptance of these general conditions of use of the Application (hereinafter the "GCUAs"), which are the responsibility of Swan.
Swan, a simplified joint-stock company (SAS) with a capital of 16999,66 €, whose registered office is at 95 avenue du président Wilson, 93100, Montreuil - registered with the 853 827 103 Trade and Companies Register, is an electronic money institution authorised to provide payment services, approved under number 17328 by the French Prudential Supervisory Authority (*Autorité de contrôle prudentiel* - ACPR) 4, place de Budapest CS92459 - 75436 Paris Cedex 09 and subject to the supervision of this authority. The list of electronic money institutions is available from the ACPR and on the website https://acpr.banque-france.fr.
In the GCUAs, capitalised terms and expressions have the meanings set out below, whether used in the singular or plural.
Apple Pay: means the payment platform that uses Apple's technology to enable users to make payments using compatible Apple Terminals and the Apple PIN.
Apple Wallet: means the application made available by Apple to holders of compatible Apple Terminals allowing them to dematerialise and access all types of cards (e.g. loyalty cards, bank cards, boarding passes), tickets (e.g. cinema tickets, show or concert tickets) or coupons and which can be used as a payment instrument when associated with Apple Pay.
Application: means the free mobile application available or downloadable on the User's Terminal enabling them to access the Swan Service, once the User has subscribed to the Service.
Customer: means the person who has subscribed to an Account for their personal or professional needs.
Android PIN: means the code used to unlock Android Terminals and which must be entered by the User each time they receive instructions to use the Application.
Apple PIN: means the code used to unlock Apple Terminals and which must be entered by the User each time they receive instructions to use the Application. The Apple PIN also incorporates Apple's Face ID and Touch ID technologies.
Strong Personal Authentication Device: means the technical device provided personally to the Customer or User enabling them to validate certain sensitive operations (such as access to the Application, adding a new beneficiary, validating a transfer, generating a card, validating an e-commerce card payment, etc.).
Google Pay: means the payment platform that uses Android technology to enable users to make payments using compatible Android Terminals and the Android PIN.
Google Pay Wallet: means the digital wallet developed by Google, in particular for managing the bank cards that the User has entered to use the Google Pay payment service. Google is solely responsible for its operation.
Apple ID: means the personal identifier or iCloud ID, which can be created online at https://www.icloud.com or when activating an Apple device, and which allows access to additional services on Apple devices (Cloud, App Store, device interoperability, etc.).
NFC: stands for Near Field Communication, i.e. short-range wireless communication.
Service: means the use of the Application and, where applicable, of certain features of the Account by the User through the Application.
Terminal: means the terminals under iOs or Android compatible with the Service.
User: means any natural person who accesses the Application.
The purpose of these GCUAs is to define the conditions under which Swan makes the Application available to the User.
To benefit from access to the Application and, if they subscribe to the Service, Users must have a compatible Terminal. It is up to the User to check this compatibility.
It is the User's responsibility to update the software on their Terminal to ensure the proper functioning of the Application and, if they subscribe to it, of the Service.
The Application can be downloaded from the App Store or the Google Play Store from its Terminal (connection costs due to the download vary according to the mobile offer purchased) if the application is not already installed on the Terminal in question.
The User must enter their mobile phone number for the creation of their account on the Application and Swan may implement additional verification measures such as sending a verification code or scanning a QR code.
At Swan's discretion, the User may be asked, via the Strong Personal Authentication Device, to transmit the identification elements necessary to verify their identity or to open their Account in accordance with the provisions set out in the general conditions of the Account.
The Application can be downloaded free of charge (excluding any connection fees charged by your operator) by Users and the possibility of benefiting from the Service is provided for an indefinite period of time.
Swan reserves the right to automatically suspend access to the Application, which will result in the interruption of the Service, without notice or compensation, in particular in the following cases:
- Any hacking or attempted illegal use of the Application;
- Where a hack or an attempt to hack the Application or the Service is caused by or due to the connection with the Terminal.
In addition, any suspension of the Account by Swan for a reason provided for in the general conditions of use of the Account will result in the suspension of access to the Application and consequently to the Service.

The download and use of the Application are free of charge, subject to connection costs related to the installation and use of the Application from the Terminal.
In the event of difficulties related to the installation of the Application on the Terminal, the User may contact the chat directly on the Application or consult the website https://support.swan.io/.
In the event of loss or theft of the Terminal, the Customer or User must immediately notify Swan customer service on the chat or at the address support@swan.io for their account to be blocked.
In the event of a change of Terminal for any reason whatsoever, the Customer and/or User is responsible for reinstalling the Application on their new Terminal.
Swan implements the means necessary for the proper functioning of the Application. In any event, Swan cannot be held liable in the event of disputes that may arise, with the exception of any damage that may be directly attributed to Swan.
Swan cannot be held liable in the event of fraudulent downloading or use of the Application by the Customer, Users or any other third party.
Swan is not responsible for the use made by Users of the Application and Service.
In addition to the stipulations in the general conditions of use of the Accounts, Swan cannot be held responsible for:
- a temporary or permanent interruption of the Application due to an event beyond its control, such as, for example, the disruption of radio transmissions;
- atmospheric conditions, hazards in the propagation of waves or the presence of the User outside Internet coverage areas; or
- a temporary interruption of the Application linked to a Swan maintenance operation.
For the purposes hereof, Swan grants the Customer and the User, for the sole duration hereof, an authorisation of use limited to the purpose hereof. The Customer and the User shall refrain from any use whatsoever of the software for other purposes or for purposes that are misappropriated or contrary to the purpose hereof. Furthermore, these general conditions do not confer any intellectual property rights on these elements to the Customer and the User. The Customer and the User undertake to respect the proprietary notices appearing on the software, media and documentation.
The Customer and the User formally undertake not to reproduce the software, permanently or temporarily, in whole or in part, by any means and in any form, including when loading, displaying, running or storing the software. They also undertake not to reverse engineer, disassemble, decompile or discover the source code of the software made available to them. The Customer and/or the User undertake not to translate, adapt, arrange or modify the software, export it, merge it with other computer applications.
Swan, or any entity that replaces it, expressly reserves the exclusive right to intervene on the software to enable it to be used in accordance with its intended purpose and in particular to correct errors. The Customer and the User therefore formally undertake not to intervene or have a third party intervene on the software. The provision of the Software cannot be considered as an assignment, within the meaning of the Intellectual Property Code, of any intellectual property right for the benefit of the Customer or the User.
The personal data collected is subject to processing, for which Swan is data controller, in accordance with the regulations on the protection of personal data. Swan undertakes to comply with the regulations in force applicable to the processing of personal data and, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 and comply with the provisions of its Personal Data Protection and Cookies Policy accessible by clicking here.
Swan reserves the right to modify these GCUAs at any time.
The current version of the GCUAs can be consulted at any time from the Application.
Swan may amend or modify these GCUAs in any way. The continued use of the Application by the Customer and, if applicable, the User after said modifications constitutes acceptance of the new GCUAs.
The GCUAs are subject to French law and, subject to the applicable legal provisions, to the exclusive jurisdiction of the courts within the jurisdiction of the Paris Court of Appeal.
Swan met à disposition de ses clients l’application mobile Swan (ci-après l’« Application ») lui permettant de prouver son identité, de réaliser une authentification forte, de s’authentifier pour accéder à son compte de paiement ou son compte de monnaie électronique (ci-après le « Compte ») et préparer ou autoriser des transactions.
Les modalités d’utilisation du Compte sont définies dans les conditions générales d’utilisation ou les conditions générales d’utilisation de monnaie électronique.
L’accès et l’utilisation de l’Application objet des présentes supposent l’acceptation préalable et sans réserve par l’Utilisateur des présentes conditions générales d’utilisation de l’Application (ci-après les « CGUA ») relevant de la responsabilité de Swan.
Swan, SAS au capital de 16 699,66 €, ayant son siège social au 95 avenue du président Wilson, 93100, Montreuil - RCS 853 827 103 est un établissement de monnaie électronique habilité à prester des services de paiement agréé sous le numéro 17328 par l’Autorité de Contrôle Prudentiel et de Résolution (ACPR) 4, place de Budapest CS92459 - 75436 Paris Cedex 09 et soumis au contrôle de cette même autorité. La liste des établissements de monnaie électronique est disponible auprès de l’ACPR et sur le site Internet https://acpr.banque-france.fr.
Dans les CGUA, les mots et expressions identifiés par une majuscule ont la signification indiquée ci-après, qu’ils soient au singulier ou au pluriel.
Apple Pay : désigne la plate-forme de paiement qui utilise la technologie d'Apple pour permettre aux utilisateurs d'effectuer des paiements à l'aide des Terminaux Apple compatibles et du Code confidentiel Apple.
Apple Wallet : désigne l’application mise à disposition par Apple des détenteurs de Terminaux Apple compatibles permettant de dématérialiser et d’accéder à tous types de cartes (ex. cartes de fidélité, cartes bancaires, cartes d’embarquement), tickets, billets (ex. ticket de cinéma, tickets de spectacles ou concert) ou coupons et pouvant être utilisée en tant qu’instrument de paiement lorsqu’il est associé à Apple Pay.
Application : désigne l’application mobile gratuite disponible ou téléchargeable sur le Terminal de l’Utilisateur lui permettant d’accéder au Service Swan, dès lors que l’Utilisateur a souscrit au dit Service.
Client : désigne la personne qui a souscrit pour ses besoins personnels ou pour ses besoins professionnels à un Compte.
Code confidentiel Android : désigne le code permettant de déverrouiller les Terminaux Android et devant être saisi par l'Utilisateur à chaque fois qu'il en reçoit l'instruction pour utiliser l’Application.
Code confidentiel Apple : désigne le code permettant de déverrouiller les Terminaux de marque Apple et devant être saisi par l'Utilisateur à chaque fois qu'il en reçoit l'instruction pour utiliser l’Application. Le Code confidentiel Apple intègre également les technologies Face ID et Touch ID d’Apple.
Dispositif d’Authentification Forte Personnel : désigne le dispositif technique fourni personnellement au Client ou à l’Utilisateur lui permettant de valider certaines opérations sensibles (telles par exemple que l’accès à l’Application, l’ajout d’un nouveau bénéficiaire, la validation d’un virement, la génération d’une carte, la validation d’un paiement carte e-commerce, etc.).
Google Pay : désigne la plate-forme de paiement qui utilise la technologie Android pour permettre aux utilisateurs d'effectuer des paiements à l'aide des Terminaux Android compatibles et du Code confidentiel Android.
Google Pay Wallet : désigne le portefeuille numérique développé par Google permettant notamment de gérer les cartes bancaires que l’Utilisateur a renseigné pour utiliser le service de paiement Google Pay. Son fonctionnement relève de la seule responsabilité de Google.
Identifiant Apple : désigne l’identifiant personnel ou identifiant iCloud, pouvant être créé en ligne sur https://www.icloud.com ou lors de l’activation d’un appareil Apple, et qui permet d’accéder à des services supplémentaires sur les appareils Apple (Cloud, App Store, interopérabilité des appareils…).
NFC : signifie Near Field Communication, c’est-à-dire la communication sans-fil à courte portée.
Service : désigne l’utilisation de l’Application et le cas échéant de certaines fonctionnalités du Compte par l’Utilisateur par le biais de l’Application.
Terminal : désigne les terminaux sous iOs ou Android compatibles avec le Service
Utilisateur : désigne toute personne physique qui accède à l’Application.
Les présentes CGUA ont pour objet de définir les conditions dans lesquelles Swan met l’Application à disposition de l’Utilisateur.
Pour bénéficier de l’accès à l’Application et, en cas de souscription au Service, les Utilisateurs doivent disposer d’un Terminal compatible. Il appartient à l’Utilisateur de vérifier cette compatibilité.
Il appartient à l’Utilisateur de procéder aux mises à jour logicielles de son Terminal pour assurer le bon fonctionnement de l’Application et, en cas de souscription à ce dernier, du Service.
L’Application est téléchargeable à partir de l’App Store ou du Google Play Store depuis son Terminal (coûts de connexion dus au téléchargement variable selon l’offre mobile détenue) si l’application n’est pas déjà installée sur le Terminal en question.
L’Utilisateur devra renseigner son numéro de téléphone mobile pour la création de son compte sur l’Application et Swan pourra mettre en œuvre des mesures de vérification supplémentaires telles que l’envoi d’un code de vérification ou le scan d’un QR code.
A la discrétion de Swan, il pourra être demandé à l’Utilisateur, par le biais du Dispositif d’Authentification Forte Personnel, de transmettre les éléments d’identification nécessaires à la vérification de son identité ou à l’ouverture de son Compte conformément aux dispositions prévues dans les conditions générales du Compte.
L’Application est téléchargeable gratuitement (hors frais éventuels de connexion facturés par votre opérateur) par les Utilisateurs et la possibilité de bénéficier du Service est fournie pour une durée indéterminée.
Swan se réserve le droit de suspendre de plein droit l’accès à l’Application ce qui aura pour conséquence l’interruption du Service, sans préavis ni indemnité, notamment dans les cas :
Par ailleurs, toute suspension du Compte par Swan pour un motif prévu dans les conditions générales d’utilisation du Compte entraînera la suspension de l’accès à l’Application et par conséquent au Service.
Dans l’hypothèse où l’Utilisateur souhaiterait résilier le Service, il lui appartiendra d’en faire la demande à l’adresse suivante support@swan.io
Le téléchargement et l’utilisation de l’Application sont gratuits sous réserve des coûts de connexion liés à l'installation et à l'usage de l’Application depuis le Terminal.
En cas de difficultés liées à l’installation de l’Application sur le Terminal, l’Utilisateur peut contacter le chat directement sur l’Application ou consulter le site internet https://support.swan.io
En cas de perte ou de vol du Terminal, le Client ou l’Utilisateur devra avertir aussitôt le service client Swan sur le chat ou à l’adresse support@swan.io aux fins de blocage.
En cas de changement de Terminal pour quelque raison que ce soit le Client et/ou l’Utilisateur prend à sa charge de réinstaller l’Application sur son nouveau Terminal.
Swan met en place les moyens nécessaires au bon fonctionnement de l’Application. En tout état de cause, Swan ne pourra être tenue responsable en cas de litiges pouvant naître à l’exception des éventuels dommages pouvant être directement imputés à Swan.
La responsabilité de Swan ne pourra pas être engagée en cas de téléchargement ou d’utilisation frauduleuse par le Client, les Utilisateurs, ou tout autre tiers de l’Application.
Swan n'est pas responsable de l'utilisation faite par les Utilisateurs de l’Application et du Service.
En complément des stipulations figurant dans les conditions générales d’utilisation du Comptes, la responsabilité de Swan ne saurait être engagée du fait :
Pour les besoins des présentes, Swan accorde au Client et à l’Utilisateur, pendant la seule durée des présentes, une autorisation d'utilisation limitée à l'objet des présentes. Le Client et l’Utilisateur s'interdisent tout usage quel qu'il soit du logiciel à d'autres fins ou à des fins détournées ou contraires à l'objet des présentes. Par ailleurs, les présentes conditions générales ne confèrent au Client et à l’Utilisateur aucun droit de propriété intellectuelle sur ces éléments. Le Client et l’Utilisateur s'obligent à respecter les mentions de propriété figurant sur le logiciel, les supports et la documentation.
Le Client et l’Utilisateur s'interdisent formellement de reproduire de façon permanente ou provisoire le logiciel en tout ou partie, par tout moyen et sous toute forme, y compris à l'occasion du chargement, de l'affichage, de l'exécution ou du stockage du logiciel. Ils s'interdisent également de faire de l'ingénierie à rebours, désassembler, décompiler ou découvrir le code source du logiciel mis à leur disposition. Le Client et/ou l'Utilisateur s'interdisent de traduire, adapter, d'arranger ou de modifier le logiciel, de l'exporter, de le fusionner avec d'autres applications informatiques.
Swan, ou toute entité qu'elle se substituerait, se réserve expressément le droit exclusif d'intervenir sur le logiciel pour lui permettre d'être utilisé conformément à sa destination et notamment pour en corriger les erreurs. Le Client et l’Utilisateur s'interdisent donc formellement d'intervenir ou de faire intervenir un tiers sur le logiciel. La mise à disposition du Logiciel ne saurait être considérée comme une cession au sens du Code de la propriété intellectuelle d'un quelconque droit de propriété intellectuelle au bénéfice du Client ou de l’Utilisateur.
Les données à caractère personnel recueillies font l’objet de traitements dont le responsable est Swan, conformément à la réglementation relative à la protection des données à caractère personnel. Swan s’engage à respecter la réglementation en vigueur applicable au traitement de données à caractère personnel et, en particulier, le règlement (UE) 2016/679 du Parlement européen et du Conseil du 27 avril 2016 et à respecter les dispositions de sa Politique de protection de données à caractère personnel et cookies accessible en cliquant ici.
Swan se réserve le droit de modifier à tout moment les présentes CGUA.
La version en vigueur des CGUA peut être consultée à tout moment depuis l’Application.
Swan est susceptible d'amender ou de modifier d'une quelconque façon les présentes CGUA. La poursuite de l’utilisation de l’Application, par le Client et le cas échant l’Utilisateur, après lesdites modifications vaut acceptation des nouvelles CGUA.
Les CGUA sont soumis au droit français et, sous réserve des dispositions légales applicables, à la compétence exclusive des juridictions du ressort de la Cour d’appel de Paris.
